These Terms & Conditions govern your access to and use of our website, platform, and services. By accessing, browsing, registering, or using any part of the platform or availing any service, you agree to be bound by these Terms & Conditions, our Privacy Policy, and our Cancellation & Refund Policy.

  • “Platform” means the website, mobile application, or any digital interface operated by Aayush Labs.
  • “Services” means diagnostic testing services, home sample collection, consultations, wellness services, or any other services offered by Aayush Labs from time to time.
  • “Booking” means a confirmed service request made through the platform.
  • “Booking ID / Order ID” means the unique reference number issued upon successful booking/payment.

 

Eligibility

By using the platform or services, you represent and warrant that:

  • You are 18 years of age or older and legally capable of entering into a binding contract.
  • The information provided by you is true, accurate, and complete.
  • You will use the platform and services only for lawful purposes and in compliance with applicable laws.

You are responsible for all activities carried out under your account or booking.

 

Nature of Services

Aayush Labs provides diagnostic and wellness services, which may include but are not limited to:

  • Home sample collection for diagnostic tests
  • Diagnostic testing through partner laboratories
  • Health and wellness consultations
  • Preventive health packages and related services

Services are non-transferable and may be availed only by the person in whose name the booking is made.

The Services are not intended for use in medical emergencies, critical care, or situations requiring immediate medical attention. In such cases, users are advised to contact emergency medical services or visit the nearest hospital immediately.

 

Booking, Scheduling & Availability

  • Service slots, including sample collection times, are indicative and subject to availability.
  • Aayush Labs reserves the right to reschedule or cancel a booking with prior intimation due to operational constraints or circumstances beyond reasonable control.
  • Services should not be availed in medical emergencies.

 

Sample Collection & Reports

  • Sample collection is conducted as per the selected booking slot, subject to availability.
  • Delays may occur due to traffic, weather, regulatory restrictions, technical issues, or other unforeseen circumstances.
  • Test reports are generated within the estimated turnaround time communicated at booking; however, certain tests may require additional processing time.
  • Diagnostic reports must be interpreted in consultation with a qualified medical professional and should not be solely relied upon for medical decisions.
  • Diagnostic reports are based solely on the samples provided and information available at the time of testing. Results may vary due to biological variables, sample quality, or external factors. Aayush Labs does not guarantee absolute accuracy and shall not be liable for any decisions taken solely based on test reports without professional medical consultation.

 

User Obligations During Sample Collection

You agree to ensure availability at the provided address during the confirmed slot, provide accurate contact details, and cooperate with field personnel. Failure to do so may result in cancellation, rescheduling, or deductions as per the Cancellation & Refund Policy. Aayush Labs shall not be responsible for failed collections due to incorrect details, non-availability, or non-cooperation.

 

Payments

  • Payments may be made through approved online payment gateways, UPI, cards, net banking, or other modes made available on the platform.
  • Services will be initiated only after successful realization of payment, unless otherwise specified.
  • Aayush Labs is not responsible for failures or delays caused by third-party payment service providers.

 

Cancellation & Refunds

All cancellations, rescheduling, deductions, and refunds are governed strictly by the Cancellation & Refund Policy published on the platform, which forms an integral part of these Terms & Conditions.

By using the services, you expressly agree to the timelines, deductions, and conditions set out therein.

 

Service-Specific Deductions

Once a booking is confirmed, operational processes including technician assignment, route planning, and consumable allocation are initiated. Cancellations made after dispatch of field personnel may attract deductions towards logistics and operational costs already incurred.

 

Personal Data & Privacy

Your use of the platform and services is governed by our Privacy Policy, which explains how personal and sensitive health data is collected, used, stored, and shared.

By using the platform, you consent to receive service-related communications including calls, SMS, WhatsApp messages, emails, and notifications for booking confirmations, service updates, feedback, and support purposes. Marketing communications, if any, shall be governed by your preferences under the Privacy Policy.

 

No Medical Advice

Information provided through the platform is for informational and scheduling purposes only and does not constitute medical advice, diagnosis, or treatment.

Aayush Labs does not replace professional medical consultation. You are advised to consult qualified healthcare professionals for medical decisions.

 

No Doctor–Patient Relationship

Use of the platform or services does not create a doctor–patient relationship between you and Aayush Labs. Any interaction with healthcare professionals or laboratories is on a principal-to-principal basis.

Where diagnostic services are performed by partner laboratories, such laboratories shall be solely responsible for the accuracy, quality, and compliance of tests conducted. Aayush Labs acts as a facilitator and shall not be liable for any negligence, errors, or omissions attributable to partner laboratories.

 

Limitation of Liability

To the maximum extent permitted by law:

  • Aayush Labs shall not be liable for any indirect, incidental, consequential, or special damages.
  • Liability, if any, shall be limited to the amount paid by you for the specific service giving rise to the claim.
  • Aayush Labs shall not be liable for delays, failures, or service disruptions caused by events beyond reasonable control.
  • Aayush Labs shall not be liable for delays or failure in service delivery caused by operational issues including traffic conditions, regulatory restrictions, technician unavailability, equipment malfunction, force majeure events, or third-party service dependencies.

 

Indemnity

You agree to indemnify and hold harmless Aayush Labs, its directors, officers, employees, and partners from any claims, losses, damages, liabilities, or expenses arising from:

  • Your use or misuse of the platform or services
  • Violation of these Terms & Conditions
  • Violation of applicable laws or third-party rights

 

Intellectual Property

All content, logos, trademarks, software, and materials on the platform are the intellectual property of Aayush Labs or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

 

Force Majeure

Aayush Labs shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, pandemics, government actions, natural disasters, strikes, technical failures, or regulatory changes.

 

Modification of Terms

Aayush Labs reserves the right to modify these Terms & Conditions at any time. Continued use of the platform after such changes constitutes acceptance of the revised terms.

Aayush Labs reserves the right to refuse, suspend, or cancel services or user access without prior notice in case of suspected misuse, fraudulent activity, abusive behavior towards staff, violation of these Terms, or non-compliance with applicable laws.

 

Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by the laws of India.

Any dispute shall be subject to the exclusive jurisdiction of courts at Mumbai, Maharashtra, and/or resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, as applicable.

Nothing herein shall prevent Aayush Labs from seeking injunctive or equitable relief before competent courts.

 

Grievance Redressal

For grievances or complaints, you may contact us using the details provided on the platform. We endeavor to address concerns in a timely and reasonable manner.

 

Legal Status of This Document
